Please read these Terms carefully before using our Website or placing an order.

By using our Website or purchasing products from us, you agree to these Terms together with our Privacy Policy, Shipping Policy and Refund Policy.

Nothing in these Terms affects your statutory rights as a consumer.

USING OUR WEBSITE

You may use our Website only for lawful purposes.

You must not misuse the Website, attempt to gain unauthorised access to it, introduce viruses or other malicious material, interfere with its operation, or use it in any way that violates applicable law or the rights of another person.

We may suspend or restrict access to all or part of the Website where reasonably necessary for security, maintenance, legal or operational reasons.

PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, images, nutritional information, ingredients, prices and other information displayed on our Website are accurate.

Product packaging, appearance or other details may occasionally change. You should always check the information provided on the product packaging before use, particularly if you have allergies, intolerances or specific dietary requirements.

Information provided on our Website is for general information purposes and is not intended to constitute medical advice.

If you have concerns about whether a product is suitable for you, you should seek appropriate professional advice before using it.

ORDERS

When you place an order through our Website, you are making an offer to purchase the products in your basket subject to these Terms.

After placing an order, you will normally receive an electronic acknowledgement confirming that we have received it.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

* a product is unavailable;
* payment cannot be authorised;
* there is an obvious pricing or product-description error;
* we reasonably suspect fraud or unauthorised activity; or
* we are unable to fulfil the order lawfully.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

PRICES AND PAYMENT

Prices displayed on our Website will include applicable taxes where required.

Delivery charges, where applicable, will be displayed before you complete your purchase.

We may change product prices from time to time. Price changes will not normally affect an order that has already been accepted.

If an obvious pricing error occurs, we may contact you before accepting or fulfilling the order.

Payment must be made using one of the payment methods available at checkout.

DELIVERY

Delivery arrangements, charges and estimated delivery times are explained in our Shipping Policy.

Please ensure that the delivery information you provide when placing an order is complete and accurate.

We will make reasonable efforts to deliver orders within the estimated delivery period. Unless a different period has been agreed with you, goods will be delivered in accordance with our obligations under applicable UK consumer law.

CANCELLATIONS, RETURNS AND REFUNDS

Your rights to cancel an online order and our arrangements for returns and refunds are explained in our Refund Policy.

For eligible online purchases, UK consumers generally have a statutory right to cancel within 14 days after receiving the goods, subject to applicable exceptions.

After notifying us of a valid cancellation, goods must generally be returned within a further 14 days.

Certain exceptions to the statutory right to cancel may apply, including to sealed goods which are not suitable for return due to health protection or hygiene reasons where the seal has been broken after delivery.

Please refer to our Refund Policy for full details.

Nothing in these Terms or our Refund Policy affects your statutory rights.

This aligns with the current distance-selling rules: online customers generally have 14 days after delivery to cancel an eligible purchase and another 14 days to return the goods after notifying the retailer.

FAULTY, DAMAGED OR INCORRECT PRODUCTS

Products supplied by Generate must comply with your statutory consumer rights.

Goods must be of satisfactory quality, fit for purpose and as described.

If you receive a product that is faulty, damaged, misdescribed or incorrect, please contact us as soon as reasonably possible at info@generateproducts.com.

Depending on the circumstances, you may be entitled to a refund, repair, replacement, price reduction or other remedy under applicable consumer law.

Nothing in these Terms excludes or restricts your statutory rights.

These protections cannot simply be excluded through website terms.

PRODUCT USE

Generate products should be used in accordance with the directions, serving guidance, warnings and other information provided on the product packaging.

Do not exceed any stated recommended usage unless appropriately advised by a qualified professional.

Individual requirements and responses to nutritional products may vary.

Our products and Website content are not intended to diagnose, treat, cure or prevent any disease and should not be used as a substitute for appropriate medical advice.

ALLERGIES AND DIETARY INFORMATION

Ingredient, allergen and nutritional information is provided on relevant product pages and/or product packaging.

If you have an allergy, intolerance or specific dietary requirement, please check the relevant information carefully before purchasing and consuming a product.

If you are unsure whether a product is suitable for you, please contact us before purchasing or seek appropriate professional advice.

INTELLECTUAL PROPERTY

Unless otherwise stated, the content of the Website, including the Generate name, branding, logos, product names, photographs, graphics, designs, text and other materials, is owned by or licensed to Generate Products (UK) Ltd and is protected by applicable intellectual property laws.

You may access and use our Website for personal, non-commercial purposes.

You must not reproduce, copy, distribute, modify, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.

REVIEWS, COMMENTS AND USER CONTENT

Where our Website allows you to submit reviews, comments or other content, you must ensure that your submission is lawful, truthful and does not infringe another person’s rights.

You must not submit content that is threatening, abusive, defamatory, discriminatory, fraudulent, obscene or otherwise unlawful.

We may remove or moderate user-submitted content where reasonably necessary, including where we believe it breaches these Terms or applicable law.

THIRD-PARTY SERVICES AND LINKS

Our Website may contain links to or use services provided by third parties, including payment providers, delivery services, analytics providers and other ecommerce services.

Our online store is hosted using Shopify.

We are not responsible for the content or operation of independent third-party websites. Where you choose to use a third-party website or service, its own terms and privacy policies may apply.

WEBSITE AVAILABILITY

We aim to keep our Website available, secure and accurate but cannot guarantee that access will always be uninterrupted or free from technical errors.

We may update, maintain, suspend or modify parts of the Website where reasonably necessary.

Nothing in this section affects obligations that we have in relation to orders or contracts already entered into with you.

LIABILITY

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or restricted.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.

This section does not affect your statutory consumer rights.

This is deliberately much more balanced than the old Shopify disclaimer. UK consumer terms cannot simply exclude responsibility for matters such as death/injury caused by negligence, faulty goods or goods that are not as described.

PRIVACY AND PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy and applicable data protection law.

Please review our Privacy Policy for information about how we collect, use, store and share personal information and about your data protection rights.

CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Website, products, business practices or applicable legal requirements.

The latest version will be published on this page with an updated revision date.

Changes will not retrospectively remove statutory rights or contractual rights that have already arisen.

GOVERNING LAW AND JURISDICTION

If you are a consumer in England or Wales, these Terms are governed by English law and you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may also bring proceedings in the Scottish courts.

If you live in Northern Ireland, you may also bring proceedings in the Northern Irish courts.

If you are a consumer outside the UK, you may also benefit from mandatory consumer protections provided by the laws of the country in which you live.
